Terms and Conditions

I. Preliminary Provisions

  1. The operator of the service intersiec.pl is Intersieć based in Ruda Śląska, 41-703, ul. Karola Goduli 36, NIP 6262548222.
  2. The service encompasses electronic services provided by the operator in its own name, under the domain intersiec.co.uk
  3. The service presents informational content on various IT topics as well as promotional and advertising content.
  4. Through the service, it is also possible to utilize electronic services provided by third parties.
  5. The service operates based on the rules specified in these Terms and Conditions.
  6. For matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other legal acts applicable in the territory of the Republic of Poland shall apply.
  7. These Terms and Conditions are binding for all users of the service.

II. Definitions

  1. Administrator – means Intersieć based in Ruda Śląska, 41-703, ul. Karola Goduli 36, NIP 6262548222.
  2. Service – means the internet portal encompassing electronic services provided by the operator operating under the domain intersiec.pl.
  3. User – means any person who in any way uses the service.
  4. Services – means services provided electronically by the Administrator for Users through the service, in particular:
    1. Providing content prepared by the Administrator.
    2. Using forms.
  5. Materials – texts, graphics, photos, and other resources made available on the service, particularly those constituting a work under the copyright and related rights law.

III. Rules for Using the Service

  1. Within the service, the user can utilize the following services:
    1. access materials made available on the service in such a way that the user has access to them at a time and place of their choosing, regardless of the type and method of operation of the device.
    2. use the contact form.
  2. The provision of services to users of the service is carried out based on the rules contained in these Terms and Conditions.
  3. The provision of certain services may be subject to a separate Terms and Conditions pertaining to that service.
  4. The Administrator reserves the right to restrict access to some or all services in the event of non-compliance with the provisions of these Terms and Conditions.

IV. Privacy Protection and Personal Data Protection

  1. When using certain services of the service, the user may provide their data. Providing data is voluntary but necessary for the provision of certain services.
  2. The Administrator states that it is the administrator of the personal data of users utilizing the services of the service.
  3. The Administrator will process personal data solely for the purpose of executing a given service and to the extent necessary for its execution. Processing for any other purpose will only occur after obtaining the user’s consent, if necessary due to a legal obligation of the Administrator or justified legal interest of the Administrator.

V. Protection of Copyright and Related Rights

  1. All rights to the service and all its elements (including programming solutions and materials contained therein) belong to the Administrator or entities cooperating with the Administrator and are protected by law, particularly based on the Act of February 4, 1994, on Copyright and Related Rights (Journal of Laws of 2022, item 2509, as amended), the Act of July 27, 2001, on Database Protection (Journal of Laws of 2001, No. 128, item 1402, as amended), the Act of June 30, 2000, on Industrial Property Law (Journal of Laws of 2023, item 1170, as amended), and the Act of April 16, 1993, on Combating Unfair Competition (Journal of Laws of 2022, item 1233, as amended).
  2. By using the services of the service, the user does not acquire any rights to the service and its elements, including programming solutions and materials posted on the service.
  3. The Administrator reserves that the dissemination of materials posted on the service without its consent is prohibited.
  4. A user who wishes to use materials made available within the service beyond the scope of permitted personal use should contact the Administrator to obtain written consent.
  5. Modification or blocking of materials presented within the service without the Administrator’s consent may constitute a violation of applicable laws as well as the rights of the Administrator or other persons.

VI. User’s Obligations and Rights

  1. The user agrees to use the service in accordance with applicable laws, social norms and customs, the provisions of these Terms and Conditions, and the principles of social coexistence.
  2. The Administrator is entitled to cease providing services of the service to the user in cases of:
    1. violation by the user of the law,
    2. violation by the user of the provisions of these Terms and Conditions,
    3. violation of rights, particularly copyright and personal rights of third parties.
  3. The user is entitled to the following rights concerning their personal data:
  1. the right to access data, including obtaining a copy of the data,
  2. the right to request correction of the data,
  3. the right to delete data (in certain situations),
  4. the right to lodge a complaint with the supervisory authority responsible for personal data protection,
  5. the right to restrict data processing.
  6. the right to data portability, i.e., to receive from the data administrator personal data in a structured, commonly used machine-readable format,
  7. the right to withdraw consent to the extent that it is processed based on consent. Withdrawal of consent does not affect the lawfulness of processing carried out based on consent prior to its withdrawal.

VII. Administrator’s Liability

  1. The Administrator does not guarantee continuous, uninterrupted, and undisturbed availability of the service for all users. The Administrator is entitled to interruptions or disturbances in the availability and use of the service, particularly when:
    1. It is caused by the need for repair, expansion, modification, or maintenance of hardware or software.
    2. It is caused by reasons beyond the Administrator’s control.
  2. The Administrator makes every effort to ensure that the information provided on the service is true and up to date. The Administrator cannot guarantee that every piece of information meets these conditions and that it can be used for any purpose by the user of the service. Therefore, the Administrator reserves that it is not liable for the consequences of using information obtained from the service.
  3. Regardless of other reservations, the Administrator is not liable for lost profits in connection with the use of services provided through the service.
  4. The Administrator is not responsible for users’ use of websites linked on the service.
  5. The Administrator is not responsible for damages caused by actions or omissions of users of the service.
  6. The Administrator is not liable for non-performance of services provided through the service if it is caused by third parties.
  7. The Administrator is liable for non-performance or improper performance of services provided by the service if it results from the actions of the Administrator or third parties acting on behalf of the Administrator.

VIII. Final Provisions

  1. The Administrator reserves the right to amend these Terms and Conditions. Amendments to the Terms and Conditions shall be made available to users via the service.
  2. The amendments come into force after 14 days from their publication on the service.
  3. Users who do not accept the changes should cease using the service.
  4. The applicable law is Polish law.
  5. Any disputes arising from the provisions of these Terms and Conditions shall be resolved by the court with jurisdiction over the seat of the Administrator.
